The Offerings are designed to back up data used for business purposes. Plans that are described as “unlimited” or “per user,” are subject to this Fair Use Policy, which ensures consistent service quality, stability, and reliability for all customers. You acknowledge and agree to the following:

1. Intended Use

The Offerings are intended to back up user-created business files, such as documents, spreadsheets, project files, and communication records. “Backup” is defined as a second copy of the data residing on the primary source. The service is intended to provide users with a reliable way to recover user data after incidents and is not intended for archiving purposes, bare metal backups, or other exceptionally large datasets that are not part of day-to-day operations.

2. Technical and Practical Limitations

The size and complexity of your backed-up data directly affect the performance and duration of backup and restore operations. Completion time depends on factors including but not limited to total dataset size, file count, available cloud bandwidth, and the processing power of the source device. CrashPlan does not guarantee specific backup or restoration timelines. You acknowledge that exceptionally large datasets may require extended processing and transfer times.

3. System Resources

To preserve overall service stability, CrashPlan reserves the right to review accounts with usage patterns that disproportionately consume infrastructure resources. In such cases, CrashPlan may contact you to discuss alternate backup strategies or take other actions necessary to maintain service performance for all customers.

4. Unlimited Storage

“Unlimited” storage means you can back up all essential business data from supported local drives without concern for strict caps. To maintain fast, reliable performance for all our customers, our Fair Use Policy applies. Unlimited storage covers standard endpoint backups only—network-mapped drives, servers, and NAS devices are excluded from this definition.

Our unlimited offering is not an archival service for deleting bulk data from your device, nor is it a replacement for local disk storage when additional capacity is needed. It is a second copy of the data residing on the primary source, which is intended to provide users with a reliable way to recover user data after incidents such as an accidental deletion.

If your storage requirements vastly exceed typical usage, CrashPlan will work with you to optimize your plan or add storage for a nominal fee, ensuring uninterrupted protection. Typical usage is currently defined as less than 5 TB per user.

5. Devices Per User

Depending on the Offering you purchase, each license permits the full backup of either one (1) or up to four (4) devices. If your device count exceeds typical usage, CrashPlan will work with you to adjust your plan or add additional device licenses for a nominal fee. Typical usage is currently defined as fewer than three (3) devices per user.

5. Our Rights

CrashPlan continuously works to improve its services. We may, at any time—with or without notice—change, limit, or restrict access to the Offerings, and may modify, suspend, or terminate any account. By using the Offerings, you agree to comply with this Fair Use Policy. Failure to do so may result in additional charges, suspension, or termination of your account, at CrashPlan’s sole discretion.
